Data Controller and Purposes of Processing Personal Data

This clarification text has been prepared by Baykal Makina, as the data controller, within the scope of Article 10 of the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation.

The Personal Data collected by Baykal Makina as the data controller will be processed for purposes limited to Emergency Management Processes, Conducting Information Security Processes, Conducting Employee Candidate / Intern / Student Selection and Placement Processes, Managing Employee Candidate Application Processes, Fulfilling Obligations Stemming from Employment Contracts and Legislation for Employees, Managing Employee Benefits and Welfare Processes, Conducting Audit / Ethical Activities, Conducting Training Activities, Managing Access Authorizations, Ensuring Compliance with Legislation in Activities, Conducting Finance and Accounting Affairs, Managing Loyalty Processes Related to Company / Product / Services, Conducting Assignment Processes, Tracking and Conducting Legal Affairs, Conducting Internal Audit / Investigation / Intelligence Activities, Conducting Communication Activities, Planning Human Resources Processes, Conducting / Supervising Business Activities, Conducting Occupational Health / Safety Activities, Receiving and Evaluating Suggestions for Improving Business Processes, Conducting Business Continuity Activities, Conducting Logistics Activities, Conducting Goods / Services Procurement Processes, Providing After-Sales Support Services for Goods / Services, Conducting Goods / Services Sales Processes, Managing Customer Relationship Processes, Conducting Customer Satisfaction Activities, Conducting Performance Evaluation Processes, Managing Contract Processes, Managing Supply Chain Processes, Conducting Wage Policy Processes, Conducting Product / Service Marketing Processes, Conducting Talent / Career Development Activities, Providing Information to Authorized Persons, Institutions, and Organizations, Ensuring Compliance with the Law No. 5651, Resolving Customer Issues and Complaints, Ensuring Corporate Communication, Planning and Executing Certification Activities, Conducting Import / Export Processes, Conducting Information and Communication Technologies Processes, Ensuring Compliance with Company Procedures and/or Relevant Legislation, Conducting Legal Incentive Processes, Using as Evidence in Potential Disputes, and Fulfilling Obligations Stemming from the Law No. 5615, and Ensuring Employees Benefit from Social Security and General Health Insurance rights.

To Whom and For What Purposes Personal Data May Be Transferred

These personal data may be transferred to domestic Financial Advisors, Lawyers, Banks, Public Procurement Authority, Real persons or private law legal entities, Business Partners, Affiliates and Subsidiaries, Authorized Public Institutions and Organizations, Suppliers, Customers, Customers, and Dealers within the scope of ensuring Compliance with Legislation in Activities, Fulfilling Legal Responsibilities, and for conducting Business Activities / Supervision, but are not shared with third parties located abroad.

Methods of Collecting Personal Data and Conditions of Processing

These personal data are processed based on the conditions of processing personal data by automatic or partially automatic means, such as paper-based, non-automatic methods; via digital media such as the internet, e-mail, card readers, software applications, cameras, etc., for the purposes of ensuring Public Health, Preventive Medicine, Medical Diagnosis, Treatment, and Care Services, Planning and Management of Health Services and their Financing, Establishment, Protection, and Use of Rights, Legal Obligations, Contract Performance, Legitimate Interests of the Data Controller, Legal Responsibility of the Data Controller.

Your Rights Regarding Your Personal Data

To exercise their rights regarding their personal data, individuals must first apply to the data controller. According to Article 14 of the Law, a direct complaint cannot be filed with the Personal Data Protection Board. Under the law, you can use the following rights by applying to the data controller:

  • To learn whether your personal data is processed or not
  • To request information if your personal data has been processed
  • To learn the purpose of processing your personal data and whether they are used in accordance with the purpose
  • To know the third parties to whom your personal data is transferred domestically or abroad
  • To request the rectification of the incomplete or inaccurate data, if any
  • To request the erasure or destruction of your personal data under the conditions laid down in the law
  • To request notification of the operations carried out in compliance with subparagraphs (e) and (f) to third parties to whom your personal data has been transferred
  • To object to the processing of your personal data, exclusively by automated means, which has a significant effect on you
  • To claim compensation for the damage arising from the unlawful processing of your personal data
